HIGH COURT INTERVENES IN CENTURION GOLF BALL CASE
The High Court in Pretoria has issued an interim interdict against the Centurion Golf Estate. This comes after Jan Small, who lives next to the 12th hole, took the estate’s homeowners association (HOA) to court because he alleges that golf balls are constantly hitting his house.
Small’s house is located next to the 12th hole, and he alleges that the stray balls are increasingly landing in his yard due to the hole being switched from a par five to a par four.
Small requested the urgent interim interdict against the club to revert the hole to a par five.
Through his lawyers, Small told the court that he wants the interim interdict to be seen as urgent as he needs to protect himself, his family and others living close to the hole.
The country club denied that the 12th hole poses any danger as a par five hole and denied that Small, or others, being hit by balls, are in any danger.
According to the country club, the 12th hole has been played as a par five for almost 28 years, and there’s only been one incident in which someone was struck by a stray golf ball.
The country club said the incident took place to the left of the 12th hole fairway, and Small’s house is situated on the right.
The interim interdict was granted.
