In the first round of court proceedings, US pop star Miley Cyrus lost in her attempt to dismiss a lawsuit against her based on her hit song Flowers.
Tempo Music Investments owns a share of Bruno Mars’ song When I Was Your Man. In 2020, the song’s co-writer, Philip Lawrence, sold his share of When I Was Your Man to Tempo Music Investments for an undisclosed amount.
News24 reports that because Lawrence as a co-owner could sue for infringement, Tempo as a co-owner, instead of Lawrence, can sue for infringement without joining the other co-owners.
Now the company claims that Flower unlawfully replicates When I Was Your Man.
The lawsuit states that Flowers duplicates “numerous melodic, harmonic and lyrical elements” of Mars’ When I Was Your Man. The song made it to the top of the Billboard Hot 100 in 2013.
A United States District Judge rejected Cyrus’ argument that Tempo Music Investments couldn’t bring the lawsuit.
Mars, who sang the hit song, isn’t involved in the lawsuit as Tempo Music Investments isn’t affiliated with the singer.
Soon after the court case, a spokesperson for Tempo Music Investments said the company was “thrilled but not the least surprised” by the decision and “extremely confident in prevailing” in the case.
